6. Territory and Duration of the Insurance Contract (including information on the entry into force and insurance period(s))

  • The territorial scope of the insurance contract is defined by the location of the insured property within the territory of Ukraine, excluding:
  • - territories where a state of emergency has been officially declared, or zones designated or officially recognized by competent state authorities as areas at risk of natural disaster, provided such declaration was made prior to the conclusion of the Contract;
  • - temporarily occupied territories of Ukraine;
  • - territories where Ukrainian state authorities do not currently exercise their powers, or exercise them only partially;
  • - territories where hostilities are taking place or were taking place at the time of an event potentially qualifying as an insured event, as well as territories situated along the line of combat contact and demarcation, including those defined in accordance with Order No. 376 of the Ministry for Communities and Territories Development of Ukraine dated February 28, 2025, "On Approval of the List of Territories Where Hostilities Are (Were) Taking Place or Which Are Temporarily Occupied by the Russian Federation."
  • In addition to the aforementioned territorial limitations, insurance coverage for War Risks does not extend to territories located within 100 (one hundred) kilometers of settlements situated in areas of active hostilities or under temporary occupation. To measure the straight-line distance between the locality where an event exhibiting the characteristics of an insured event occurred and the nearest locality that is under occupation or situated in an active combat zone, the insurer is entitled to use the web service https://deepstatemap.live/.
  • The term of the insurance contract is specified therein. The insurance contract does not provide for automatic renewal. Extension of the insurance contract term is possible only by mutual agreement of the Parties through the conclusion of a new insurance contract for a new term.
  • The start date of the insurance contract term is determined by agreement between the insurer and the policyholder and is specified in the contract; however, it may not be earlier than the 6th (sixth) calendar day following the date of the contract's conclusion—except in cases where a contract is concluded for a new term (continuous renewal)—nor earlier than the day following the payment of the insurance premium (or the first installment thereof, if the contract provides for installment payments). For this purpose, the date of the contract's conclusion counts as the first calendar day.
  • The insurance contract remains in effect until the expiration date specified therein.
  • If the insurance premium—or the first installment thereof, where installment payments are stipulated—is not received or is not received in full in the insurer's current account, the insurance contract shall be deemed not to have entered into force.
+

7. Exclusions from Insurance Events and Grounds for Denial of Insurance Payments

  • The policyholder bears financial liability for the untimely return of the insurance indemnity (or a portion thereof)—in cases stipulated by the insurance contract—by paying the insurer a penalty of 0.01% of the amount of the untimely returned indemnity (or portion thereof) for each calendar day of delay, provided that the total penalty does not exceed twice the NBU discount rate for the corresponding period.
  • Failure by the policyholder or the persons whose liability is insured (or the policyholder’s representatives) to provide timely notification of the occurrence of an insured event without valid reason, or failure to fulfill other obligations defined by the insurance contract or legislation—where such failure renders it impossible for the insurer to establish the fact, causes, and circumstances of the insured event or the extent of the damage (loss) incurred—constitutes grounds for refusing payment of the insurance indemnity.
  • If the insurance premium, or the first installment thereof (where the insurance contract provides for payment in installments), is not received or is not received in full in the insurer’s current account, the insurance contract is deemed not to have entered into force. In the event that the insurance contract provides for the payment of the insurance premium in installments:
  • - if a scheduled installment of the insurance premium is not received in full by the deadline specified in the insurance contract for the payment of that installment, insurance coverage under the contract is suspended starting from the day following the deadline specified in the contract for the payment of that installment;
  • - if the policyholder pays the overdue insurance premium installment within 10 (ten) calendar days after the due date specified in the contract, insurance coverage resumes at 00:00 hours on the day following the day the overdue installment is received in the insurer's current account;
  • - from the moment insurance coverage is suspended until it is reinstated, coverage under the contract is not in effect, although the contract term specified therein remains unchanged;
  • - if the policyholder fails to pay a scheduled insurance premium installment within 10 (ten) calendar days of the due date specified in the insurance contract, the contract terminates—without prior notice from the insurer to the policyholder—at 00:00 hours (Kyiv time) on the 11th (eleventh) calendar day following the due date specified in the contract for the payment of the relevant installment.
+
